This Privacy Statement explains how personal data (“Data”) is collected through this e-Commerce Marketplace (“E-Commerce Marketplace”) by CNH Industrial Australia Pty Ltd if you reside in Australia, or by CNH Industrial New Zealand Limited if you reside in New Zealand (“we”, “us”, “CNH” or the “Company”) and are handled in accordance with relevant legal and regulatory requirements. We are committed to protecting and respecting your privacy.

1. HOW WE OBTAIN THE DATA

Your data may be collected, processed, and stored as follows:

  1. Personal information (such as first name, last name, address, e-mail address, shipping and billing address etc.) you provide to us to receive a particular service, such as to create an account or acting as guest on the E-Commerce Marketplace;
  2. Browsing information, data arising from you interacting with E-Commerce Marketplace (such as Internet Protocol addresses, logs, username, visited pages, etc.) or as a result of your logging onto My Brand websites;
  3. Data received from other sources: such as Authorised dealers you select as preferred on the E-commerce Marketplace or from which you purchase certain products (“Authorised Dealers”), from CNH companies in the relevant market or from third parties such as, for example, payment service providers.

2. HOW WE USE THE DATA

The data collected may be processed by us for the purpose of:

  1. inform you and the Authorised Dealers about our products, services and distribution network or reply to your requests;
  2. share the information with the Authorised Dealers which act as agency to fulfil their obligations related to the sale of products, such as processing and handling orders placed through the Authorised Dealers.
  3. With your permission, to send commercial communications and newsletters, as well as advertising information related to our products and services or aimed at carrying out market research. All these activities may be carried out in paper form or through automated or electronic means including mail, e-mail and telephone (e.g. automated phone calls, SMS, MMS, fax) and any other means (e.g. websites, cell phone apps);
  4. With your permission, to disclose the Data to the Company's subsidiaries and affiliates as well as to the Authorised Dealers of our distribution network; these partners will process your Data for the purpose of sending commercial communications and advertising related to their products and services or aimed at performing market research - “Third Party Marketing” unless you object to such activity;
  5. analyze the purchasing process and how you and the Authorised Dealers are placing the orders through the E-Commerce Marketplace or how the Authorised Dealers handle such orders and to improve sales performance and the product offerings made by CNH and the Dealers through the E-commerce Marketplace.
  6. using data regarding your interaction with our E-commerce Marketplace in order to provide you with personalized offers or online advertisings, including through automated processes in order to create different user segments using the following logic and techniques: tracking techniques will gather your interaction with our E-commerce Marketplace and transmit to our application platform to segment your preference and allow us the possibility to send advs/communications which best suits your needs and preference. You have at amy time the right to opt out and this processing will not infer with your choices and privacy rights.

3. CONSEQUENCES OF FAILURE IN PROVIDING DATA

Providing data is not always mandatory. However if you do not provide data marked as mandatory it may prevent us from providing the required service or the product or may result in suboptimal provision of the required service or product. On the other hand, not providing Data whose provision is marked as optional will allow you to access the service or to receive the product in any event.

4. HOW WE SHARE YOUR INFORMATION

We are part of CNH, a global leader in capital goods sector. Data may be shared and communicated to our subsidiaries and affiliates of CNH, trusted external parties, service providers, Authorised Dealers and distributors and business partners, based in and outside Australia and New Zealand, which are under specific contractual obligation and may use it solely for the fulfillment of the purposes listed above. Date may be communicated to third parties to comply with legal obligations, to operate and maintain our and the CNH security, protect our and the CNH rights or property, to respond to order of Public Authorities, or to exercise our rights before judicial authorities.

This E-commerce Marketplace is managed and administered by CNH Industrial Italia S.p.A. as technical provider. For this reason, CNH Industrial Italia SpA, with registered office at Lungo Stura Lazio, 19 - 10156 Turin - Italy, acts as third-party processor of Your Data for the purposes detailed below:

  1. administrate the E-Commerce Marketplace;
  2. ensure asset and information security, to maintain the safety, security, quality, and integrity of our E-Commerce Marketplace, databases and other technology assets, including to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity, and to debug to identify and repair errors that impair existing intended functionality.
  3. use data, “cookies,” and other similar tools to understand how you and the Authorised Dealers use the E-Commerce Marketplace, produce aggregate statistics to apport improvements to the E-Commerce Marketplace, and analyze sales performance and the product offerings made by CNH group through the E-Commerce Marketplace.

Data provided for the purposes under (iii) will be processed in accordance with our Cookie Banner.

5. HOW WE TRANSFER YOUR DATA

For the purpose detailed above, Data may be shared with third party located in countries outside of Australia and New Zealand, including for storing such Data in digital or physical databases managed by entities acting on our behalf.

We ensure that we will share it outside of Australia and New Zealand only in compliance with the provisions set forth by applicable laws including, if appropriate, contractual measures to guarantee that Data is properly safeguarded and processed.

6. RETAINING YOUR PERSONAL DATA

We retain Data on our systems and archives to enable you to use our services on an ongoing basis for as long as necessary to pursue the purposes described in this Privacy Statement and in any case for no longer than a 5-year period unless greater retention is required by the applicable laws or regulations, for example, for tax and accounting purposes.

Finally, please note that the Authorised Dealers may observe different retention period acting as autonomous data controllers in their respective countries.

7. DATA AGENCY

CNH is the agency collecting your personal data through the E-Commerce Marketplace according to this Privacy Statement

Please also note that certain data processing activities on tthe E-Commerce Marketplace, such as order placements, order shipments, etc. are carried out, as autonomous data controllers, by the Authorised Dealers based in the country in which you have decided to make the purchase. Please refer to their privacy statement for more details.

8. YOUR RIGHTS

You may exercise your rights as defined by applicable laws and regulations, among these:

  • Right of access: right to obtain from the agency a confirmation as to whether your personal information is being processed, and, if so, to demand to gain access to your personal data.
  • Right to rectification: right to obtain from the Agency the rectification of your personal data that you may consider inaccurate and to have incomplete information being completed, including by means of providing a supplementary statement.
  • Right to opt-out: the right to object to the use of your Data form us
